In order to purchase a gun from a retailer, you must fill out a Firearms Transaction Record (4473 Form). This keeps track of purchased firearms and runs the required background check.
In recent House proceedings, two gun control bills have been sent to the Senate. The Enhanced Background Checks Act of 2021 (H.R. 1446) and the Bipartisan Background Checks Act of 2021 (H.R. 8) place higher restrictions on firearm purchases and would supersede individual state laws.
Currently, a federal firearms licensee is required to wait up to 3 business days for a background check to clear before transferring a gun to an unlicensed individual. The Enhanced Background Checks Act of 2021 would increase this to a 10 business day period. In addition, if 10 business days passes, the purchasing individual may submit a “final firearms eligibility determination” but may have to wait up to another 10 business days before acquiring the firearm.
The Bipartisan Background Checks Act of 2021 was proposed as a way to halt gun shows. It would require a licensed gun dealer, manufacturer, or importer to take possession of a firearm during the private firearm transfer and run a background check following the processes in the Enhanced Background Checks Act of 2021.
The “Assault Weapons Ban” bill was proposed early March 2021 and would ban the sale, transfer, manufacture and import of “assault weapons” and high-capacity magazines (10 rounds or more). It would ban over 200 firearms that have “military characteristics” including:
• All AR-style firearms
• All AK-style firearms
• Firearms with a forward grip, pistol grip, threaded barrel, barrel shroud, or a folding or telescoping stock.
• Bump stocks and similar devices that allow for semi-automatic/automatic firing.
